STOLEN PHONE INSIDE THE ER MIDDLE SCHOOL

My 8th grade son's phone was confiscated by his teacher inside the class last April 8. He was told to get it at the end of the day but he forgot to get it back so the next day he asked me if I can go to his school to get it. I just got the job and I am afraid to lose my job again if I will asked permission to go out or be late bec. I lost my previous job because of this kind of situation. So I asked my son, if I will not be able to go to his school, where does usually the phone goes after it has been confiscated by the teacher, and he said that it will be given to the Dean's office. So in my thought, that's just ok, so this will serve a lesson to my son not to use the phone inside the classroom. I was able to file 1/2 day off in time for the parent teacher conference of my 2nd grade daughter so this way it will just be 1/2 day with 2 meetings. When I came in last May 3 to the school, it was almost dismissal time and there was a brush fire along Fwy 2North at that time so when I approached the Dean he told me to see the Asst. Principal instead to open the safe where all the confiscated phones are being kept. So I met the Asst. Principal and she checked the safe but my son's name was not listed on the logbook. This mean, the substitute teacher, Ms. Gomez, did not turned over the Iphone 4S of my son to the school authorities.  I was told to just asked my son to go to her office on Monday to get his phone back and that I no longer needed to go there since I showed up already but I got suspicious when I found out that my son's phone was not on the list.   When I got home I log in to my AT&T account and found out that my son's phone is being used.  The next day, I tried to call the number that the user has called and received text messages and I spoke to a boy and asked him if he knows Ms. Gomez, the boy answered back that his mom is not there and she is at work and then he hang up.  When I tried to call back the phone just keep on ringing.  I tried to call the other number and a guy answered the phone but when I asked him if he knew Ms. Gomez, he hangs up on me.  The last activity of the phone is that it is somewhere in Pasadena. 
So I went back to the school the following Monday to see the Principal, Mr. Velasco. I met him and told him the situation. He said he will talked to the substitute teacher bec. as far as he knows, that teacher no longer works in the school for almost a semester. Days has passed by and I called Mr. Velasco to check on the situation and he told me that the teacher came to the school and denied confiscating the phone of my son. She swore an affidavit to the Principal (which I never saw) that she did not confiscated any phone from my son. So I came back to the school and talked to the Principal and asked him what is the next step. Because my son has swore in front of him that this Ms. Gomez took the phone from him inside the classroom. There were even students who witnessed this incident according to my son but the Principal did not take this into consideration and instead just asked me to go back to the Dean, Mr. Pinegar, to check if my son's phone could be in the safe but after checking and giving the IMEI of my son we did not find it on the list of phones that was turned over to them for safekeeping. So now my son's phone is considered STOLEN INSIDE THE CLASSROOM BY THE TEACHER. I went to the school yesterday, June 4, to file a police report to the Police Officer in the school and the officer told me that all he can do is to file a THEFT REPORT. I am just writing this to get parent's awareness that if your son's phone has been confiscated by the teacher, you should go to the school IMMEDIATELY otherwise the teacher can deny taking the phone away from your son and by simply writing an affidavit to the Principal they will not be liable for anything. A simple case on how to stole the phone on the students!
